In July, a federal judge in Florida permanently blocked an NRA-backed Florida law that threatened to strip doctors of their medical licenses if they warned patients about the proven risks of guns in the home. The court ruled that the law violates the First Amendment because it interferes with truthful speech about the dangers of easy access to guns.
U.S. District Court Judge Marcia Cooke found that the law illegally interfered in protected First Amendment speech to “restrict a practitioner’s ability to provide truthful, non-misleading information to a patient about the truthful risks of guns” based solely “on anecdotal information” while ignoring all “studies, research, or statistics on physicians’ practices or patients’ experiences on this issue” which show severe risks to children and families when guns are present in the home. Judge Cooke found that the law illegally “impairs the provision of medical care and may ultimately harm the patient.”
