Minutes before he was sentenced Wednesday to five to 15 years in prison for killing a couple in a high-speed crash in Hamlin in 2011, a local chiropractor apologized to the couple’s family.
“Words cannot express how truly sorry I am,” said Stephen Divito, 40, of Penfield. “I’m haunted by what I did.”
Divito pleaded guilty in October to first-degree vehicular manslaughter, second-degree vehicular assault and leaving the scene of an injury that resulted in a death, all felonies, and driving while intoxicated, a misdemeanor.
State Supreme Court Justice Joanne Winslow handed down the sentence, which includes five years of post-release supervision. Divito’s license will be revoked during that time, and he also will need to install an ignition interlock device in his car.
On Nov. 5, 2011, Divito caused a crash that killed Patricia Trabold-DePinto, 57, and James DePinto, 61. He drove into the couple’s car on the Lake Ontario State Parkway, near Route 259, then sped away from the scene about 4 p.m., according to the Monroe County Sheriff’s Office.
